Determining setback on an tapered lot for proximity damages

Postby jnkhams31 on Thu Feb 12, 2009 12:51 pm

Hi,
I have a quick question I hope someone can help me with. The situation is a tapered piece of property being acquired from the front yard of a residence for a turn lane project. In determining the distance of the new setback for proximity damages, should the average setback of the angled property be calculated and used, or the closest point from residence to new right of way? The closest point is directly in front of the house and the tapered end is at the far edge of the property.
Thanks for any help.
